Digital Millennium Copyright Act Notice & Takedown Procedures

1. Commitment to Copyright Protection

Aliholly LLC ("Aliholly," "we," "us," or "our") respects the intellectual property rights of others and expects all users of our platform to do the same. We comply with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA") and respond promptly to notices of alleged copyright infringement that comply with the DMCA and applicable regulations.

We will remove or disable access to material that we determine, in good faith, infringes the copyright of a third party. We will also terminate the accounts of users who are repeat infringers.

3. Filing a DMCA Takedown Notice

If you are a copyright owner (or authorized to act on behalf of one) and believe that content on Aliholly infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include all of the following:

  1. Identification of the copyrighted work — Identify the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, provide a representative list of such works.
  2. Identification of the infringing material — Identify the material that you claim is infringing and provide information reasonably sufficient to permit us to locate the material on our platform (e.g., URL, page title, creator name, or film/music title).
  3. Your contact information — Provide your full legal name, mailing address, telephone number, and email address.
  4. Good faith statement — Include the following statement: "I have a good faith belief that use of the material described above is not authorized by the copyright owner, its agent, or the law."
  5. Accuracy and authority statement — Include the following statement: "The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  6. Your signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Warning: Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Do not file a DMCA notice unless you are the copyright owner or genuinely authorized to act on their behalf.

4. How We Respond

Upon receiving a valid DMCA takedown notice, Aliholly will:

  1. Remove or disable access to the allegedly infringing material promptly (typically within 24–48 hours of receipt).
  2. Notify the uploader — We will make a good faith effort to notify the user who uploaded the material that it has been removed or disabled, and provide them with a copy of the takedown notice (with the complainant's personal information redacted as appropriate).
  3. Record the incident — The takedown will be recorded in the user's account for purposes of our Repeat Infringer Policy (see Section 7 below).

5. Counter-Notification (Disputing a Takedown)

If you are a user whose content was removed and you believe the removal was a mistake or that you have authorization to use the material, you may file a counter-notification. Your counter-notification must include:

  1. Identification of the material — Identify the material that was removed and the location where it appeared before removal.
  2. Your contact information — Your full legal name, mailing address, telephone number, and email address.
  3. Consent to jurisdiction — A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the District of Wyoming), and that you will accept service of process from the person who filed the original DMCA notice or their agent.
  4. Good faith statement — A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  5. Your signature — A physical or electronic signature.

Upon receiving a valid counter-notification, Aliholly will forward a copy to the original complainant. If the original complainant does not file a court action seeking a restraining order against the user within 10 to 14 business days, Aliholly may restore the removed material.

6. Content Scanning and Proactive Measures

In addition to our DMCA takedown process, Aliholly employs proactive technical measures to detect and prevent copyright infringement on the platform, including:

Content flagged by our scanning systems may be held for review, rejected, or removed prior to or after publication. These measures supplement but do not replace the DMCA notice-and-takedown process.

7. Repeat Infringer Policy

Three-Strike Policy

Aliholly maintains a strict repeat infringer policy in accordance with 17 U.S.C. § 512(i):

Strikes are recorded permanently and are not reset over time. A strike may be removed only if a valid counter-notification is filed and the original complainant does not pursue legal action within the statutory period.

Aliholly reserves the right to terminate any user's account at any time for a single instance of willful, egregious, or commercial-scale copyright infringement, without following the three-strike progression.

8. Accommodation of Standard Technical Measures

Aliholly does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as defined in 17 U.S.C. § 512(i). We accommodate and do not disable, circumvent, or otherwise interfere with such measures.

9. No Obligation to Monitor

While Aliholly employs proactive scanning and review measures, nothing in this policy creates an obligation for Aliholly to monitor, review, or pre-screen all content uploaded to the platform. Aliholly acts in good faith to address copyright infringement when notified or when identified through our technical measures.

10. International Users

If you are located outside the United States, please note that our DMCA procedures comply with U.S. law. We may also comply with equivalent procedures under the laws of other jurisdictions where applicable. Copyright owners outside the U.S. are welcome to submit notices using the procedure described above.

11. Amendments

Aliholly reserves the right to modify this DMCA Policy at any time. Changes are effective immediately upon posting. Your continued use of the platform after any modification constitutes your acceptance of the updated policy.
